The following is the agenda for the meeting of October 9, 2008. I apologize for not posting it prior to this date. The city staff was unable to get the agenda packet completed last week.

PUBLIC HEARING
It is recommended that the Planning Commission consider recommending that the City Council, (1) Certify an addendum to the Environmental Impact Report (EIR No. 2004091167) and subsequent CEQA documents, and (2) Approve an amendment to the University Village Tentative Map, and (3) Approve revised site plan for Phase 1B and revised Project and Tenant Sign Criteria for retail phases 1A and 1B subject to conditions, of the Dunes on Monterey Bay (formerly University Village) development project originally approved by Council on May 31, 2005.

SEPT. 25 PLANNING COMMISSION MEETING

PUBLIC HEARINGS: Time will be set aside during the Public Hearing to receive oral comments on all items listed as Public Hearings. Staff will present the project and staff recommendation and answer questions from the Planning Commissioners. The applicant will then have the opportunity to raise any issues with the staff recommendation. The public will then be invited to approach the podium to provide up to three (3) minutes of public testimony.
a. Recommendation to consider adoption of Resolution no. 2008- amending Use Permit 76-06 for Marina Cypress Apartments at 3306 Del Monte Boulevard to remove the condition of approval requiring a conservation and scenic easement deed over the rear portion of the property that is vacant and zoned “R-1” Single-Family APPROVED 7-0
b. Recommendation to open a public hearing, take any testimony from the public and consider adopting Resolution 2008- approving Use Permit 2008-06 to allow an on-site caretaker unit for the Smith Business Center located at 3340 Paul Davis Drive (APN 033-012-023)APPROVED 7-0

The Planning Commission meeting of Sept. 11, 2008 has been cancelled.

AUG. 28TH PLANNING COMMISSION MEETING

7. INFORMATIONAL PRESENTATIONS (NO ACTION):
a. Informational commercial sign presentation to address signs in an urban environment and the regulation and enforcement of city standards and guidelines.

This is an information gathering meeting. People who desire to know more about city policy and guidelines on signs should attend at 211 Hillcrest or watch on Channel 25 at 6:30 p.m.

AUGUST 14TH PLANNING COMMISSION MEETING

There will be no meeting of the planning commission on August 14th.

JULY 24TH PLANNING COMMISSION MEETING

PUBLIC HEARINGS: Time will be set aside during the Public Hearing to receive oral comments on all items listed as Public Hearings. Staff will present the project and staff recommendation and answer questions from the Planning Commissioners. The applicant will then have the opportunity to raise any issues with the staff recommendation. The public will then be invited to approach the podium to provide up to three (3) minutes of public testimony.

a. Recommendation to open a public hearing and take any testimony from the public to consider adopting Resolution No. 2008- adopting a Mitigated Negative Declaration and Monitoring Program (ND2008-02) for the re-construction of Reservation Road from Beach Road to Del Monte Boulevard.
Passed 5-0. The item did not involve the design of the project. It only involved the question of acceptance or rejection of the negative declaration and whether or not the project was consistent with the General Plan.
There was a reference to the design being faulty and inaccurate as to size of roundabouts and existence of an added section to Hilo, but those items were not formally addressed because the design has to be reviewed and presented at a later time to the appropriate agency.

8. ACTION ITEMS: Action listed for each Agenda item is that which is recommended by staff. The
Planning Commission may, at its discretion, take action on any items. The public is invited to

a. Recommendation to consider adopting Resolution No. 2008- making a determination that
the Marina five (5) year Capital Improvement Program is consistent with the Marina
General Plan. PASSED 5 TO 1. Commissioner O’Connell voted no because of concerns that he had about certain vital information not being disclosed in the documents presented to the commission.

7. PUBLIC HEARINGS: Time will be set aside during the Public Hearing to receive oral comments on all items listed as Public Hearings. Staff will present the project and staff recommendation and answer questions from the Planning Commissioners. The applicant will then have the opportunity to raise any issues with the staff recommendation. The public will then be invited to approach the podium to provide up to three (3) minutes of public testimony.

a. Use Permit UP 2008-02 is requested to allow the sale of alcohol at a one day event known as “Concorso Italiano” on a portion of the City of Marina Municipal Airport located on the east side of Imjin Rd immediately east of Building 510 (APN: 31-111-37). The Consorso Italiano event would take place on August 15, 2008 and would involve the display of Italian automobiles, vintage aircraft, fashion show, music, merchandise vending booths, and on site food and alcohol sales. The event site is located in an area designated for use as Light Industrial/Service Commercial in the General Plan and “A-1” (Airport) District in the Zoning Ordinance. The project is exempt from environmental review pursuant to Section 15061(b)(3) “General Rule” of the California Environmental Quality Act (CEQA) in that CEQA only applies to projects which have the potential of causing a significant effect on the environment. The City of Marina is the property owner and Concorso Italiano is the applicant. PASSED 6 TO 1. Commissioner O’Connell voted no because the use permit did not set forth opening and closing times for the sale of alcoholic beverages at the event. The resolution was modified to reflect that it is a two day event.

AGENDA MAY 8TH PLANNING COMMISSION

3. Minutes of Public Testimony:

a. Recommendation to open a public hearing, receive any testimony from the public and consider adopting Resolution No. 2008- an amendment to the Marina General Plan including Figure 2.4 Downtown Vitalization Area, amending Section 5.11 to require that a specific plan be prepared for the Downtown
Vitalization area, amending Figure 1.2 to add Downtown Vitalization Area overlay to the Central Marina sub area, removing Section 2.41.6 requiring any development proposed in the Core Retail Area to prepare a specific plan and adding Policy 2.63.51 defining Downtown Vitalization Area. Development in the
downtown area will require preparation of a specific plan that would eventually be folded into the Downtown Specific Plan. This approach will ensure that development is consistent with the goals and policies of the General Plan, Downtown Vision and Downtown Design Guidelines. The project is categorically exempt from environmental review pursuant to Sections This project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) (General Rule).

Passed 5-0 with recommendations as to two areas and clarification of figure 1.2
